Conditions - PACCAR PARTS MAX CARD


 

1.

GENERAL

1.1

These General Terms and Conditions apply to applying for and owning a MAX Card. The MAX Card programme is conducted by DAF Trucks N.V., Hugo van der Goeslaan 1, 5643 TW, Eindhoven, The Netherlands (Chamber of Commerce number 17078445), and the MAX Card is and shall remain the property thereof.

1.2

By using the MAX Card you declare that you have familiarised yourself with these General Terms and Conditions, that you have understood them and that you agree with their application.

1.3

As a participant in the MAX Card programme you can, when you show your MAX Card, enjoy benefits on certain products from the participating authorised DAF Service DealerTM you specified. The participating authorised DAF Service DealersTM determine how much and subject to which conditions you can obtain benefits when purchasing certain products or services. You must refer any disputes on whether benefits are or are not given to the participating DAF Service DealerTM.

  

2.

REGISTRATION

2.1

All natural persons of age with a residential and correspondence address in Great Britain, as well as all legal entities or partnerships based in Great Britain can request a MAX Card at www.paccarparts.co.uk/maxcard. With the exception of 2.2

2.2

If you or the legal entity or company at which you are employed participate in the PACCAR Parts Fleet Services programme, you are excluded from participation in the MAX programme.

2.3

If you or the legal entity or company at which you are employed commence participation in the PACCAR Parts Fleet Services programme during the time in which you are a MAX Cardholder, your Max Card ownership will become invalid 14 days after you or the legal entity or partnership at which you are employed commences participation in the PACCAR Parts Fleet Services programme, in accordance with the provisions of Section 16.1 of these Terms and Conditions.

  

3.

MAX CARD

3.1

Your MAX Card is in the applicant's name and includes a unique number.

  

4.

BENEFITS

4.1

When your order is taken at the DAF Service DealerTM participating in the MAX Card programme, the unique number corresponding to your MAX Card is requested.

When you order via the Internet, other identification details are also requested. If the MAX Card number and house number you provided with your order do not correspond to the details contained in the file at DAF Trucks N.V., the benefits will be refused and the MAX Card may be withdrawn by the DAF Service DealersTM.

In addition, DAF Trucks N.V. and the authorised DAF Service DealersTM retain the right to request proof of identity.

4.2

No rights may be derived from the above and DAF Trucks N.V. and the authorised DAF Service DealersTM retain the right to refuse a transaction.

 

5.

LIABILITY

5.1

DAF Trucks N.V. and the participating DAF Service DealersTM can not acknowledge any liability for the unauthorised use of the MAX Card or for the consequences of a delay when replacing a lost and/or stolen MAX Card.

  

6.

PERSONAL DATA

6.1

Your data is included in our file. Details of your purchases from participating DAF Service DealersTM relating to the use of the MAX Card are also included in the MAX Card files of those companies.

6.2

DAF Trucks N.V. and participating DAF Service DealersTM shall treat the aforementioned files confidentially and in accordance with all applicable privacy legislation.

6.3

In accordance with the stipulations of the Dutch Personal Data Protection Act, the file containing your information has been provided to the College Bescherming Persoonsgegevens (Data Protection Bureau Authority) in The Hague, the Netherlands. The holder of the file is DAF Trucks N.V. in Eindhoven. The relevant registration forms can be viewed at www.cbpweb.nl/asp/ORSearch.asp.

6.4

The advantage for you as a client of storing your details is that we, as well as an authorised DAF Service DealerTM you have specified, are able to instantly provide you with offers based on your own preferences, as is evident from your earlier purchase history. DAF Trucks N.V. is also able to keep a record of which products you have ordered previously, enabling you to make purchases more quickly and easily from the authorised DAF Service DealerTM you have specified. The files belonging to DAF Trucks N.V. and the authorised DAF Service DealerTM you have specified may also be used for conducting statistical and personal analyses, including those for making offers and creating newsletters.

6.5

Your data shall not be made available to third parties unless this is necessary to process your purchase, or pursuant to a legal provision, or due to an emergency insofar as we reasonably assume that this is in your own interests.

6.6

If you object to receiving offers that may or may not be personal you can indicate this via a web form at www.paccarparts.co.uk/maxcard.

If you object to the fact that your personal data is actively used in our file, or at least the file of the authorised DAF Service DealerTM you have specified, you can make this known via a web form at www.paccarparts.co.uk/maxcard.

6.7

In addition to processing personal data via the website www.paccarparts.co.uk/maxcard or the authorised DAF Service DealerTM you have specified, DAF Trucks N.V. also uses a statistics program that records how often www.paccarparts.co.uk/maxcard is visited, via which links etc. To do this we use 'cookies'. These are small files that your computer downloads when you visit www.paccarparts.co.uk/maxcard. The data we thus obtain remains anonymous.

  

7.

INTELLECTUAL PROPERTY RIGHTS

7.1

All intellectual property rights relating to www.paccarparts.co.uk/maxcard and MaxTM, including those relating to the software, text, images and sounds, remain with DAF Trucks N.V. and/or those from whom we have obtained a licence. This means inter alia that the publication, duplication or processing of the information given at www.paccarparts.co.uk/maxcard is not permitted without our consent unless it is for personal use.

  

8.

SECURITY

8.1

If you use the MAX Card, you choose an e-mail address as your user name and a password, which will give you access to the services of the special website for MAX Card holders. This information is personal and we ask that you treat it confidentially, that you only use your e-mail address and password for your own personal use and that you only save them on your own computer.

8.2

We shall do our best to ensure as far as possible that the websites are virus-free, but unfortunately we are unable to provide any such guarantees.

  

9.

PRIZES, OFFERS AND CAMPAIGNS

9.1

Most offers mentioned at www.paccarparts.co.uk/maxcard are available from the DAF Service DealerTM you specified. All offers are finite: when they are gone, they are gone. A selection of the offers is also available via other DAF Service DealersTM. They are recognisable by the DAF Service DealerTM logo.

9.2

The offers are only valid with a MAX Card for the validity period specified.

9.3

Product prices and external features may not be stated or depicted correctly due to printing errors. In that event the actual prices and external features apply and no claims for delivery based on the faulty information given will be permitted.

9.4

Discount vouchers:

• have various validity dates. On each voucher the validity is shown

• are only valid at an official participating DAF dealer in the country of issue

• entitle the holder to the discount stated on the front. This amount will be discounted by the        DAF dealer from the purchase price of the product stated on the front of the voucher

• cannot be used in combination with other special offers

• are only valid in combination with an activated MAX Card

• are redeemable dependant upon the number of vehicles registered

• can only be used once per purchased product unless otherwise indicated

• cannot be exchanged for cash

• are not valid for factory ordered options and accessories

• are not valid if this part is covered by a repair and maintenance contract

• the chassis numbers and/or registration numbers in the MAX Card programme may only be added to the MAX Cardholder who owns those vehicles or who works at the company that owns those vehicles

• DAF dealers may refuse to accept a discount voucher without reason

• DAF reserves the right to terminate the campaign at any time without reason and/or to amend the published regulations, images, prices, validity period and conditions

10.

INFORMATION VIA WEBSITES

10.1

The information on www.paccarparts.co.uk/maxcard and any other websites used by DAF Trucks N.V.relating to the MAX Card programme shall be modified from time to time. If you find any mistakes on the site(s), we would be very grateful if you could notify us using the web form at www.paccarparts.co.uk/maxcard. The www.paccarparts.co.uk/maxcard site may contain links to third party websites. We choose the websites to which links are provided as carefully as possible. However, we cannot vouch for the content and functioning of third party websites.

 

 

 

11.

LOSS OR THEFT OF THE MAX CARD

11.1

In the event of loss of the MAX Card, the MAX Card holder registered at DAF Trucks N.V. may have the relevant MAX Card blocked by reporting the loss or theft to DAF Trucks N.V. Once the MAX Card has been blocked it can no longer be used.

11.2

Loss or theft of the MAX Card can be reported to DAF Trucks N.V. in writing or electronically. Upon receipt of the written or electronic notification DAF Trucks N.V. will block the MAX Card immediately.

11.3

As soon as you have ensured that the lost or stolen MAX Card has been blocked as described above, you are no longer liable for the consequences of any unauthorised use of the MAX Card.

11.4

A new MAX Card will be provided to the MAX Card holder whose MAX Card has been lost or stolen.

  

12.

TERMINATION OF PARTICIPATION

12.1

You are entitled at all times to terminate your participation in the MAX Card programme. You can do that via a web form at www.paccarparts.co.uk/maxcard. To prevent any further use you must destroy the MAX Card yourself. Upon termination, the MAX Card will no longer provide you with any benefits.

12.2

If no purchases have been made using your MAX Card for a consecutive period of 12 months, we are entitled to withdraw your MAX Card after this period unless you inform us via a web form that you wish to retain the MAX Card. If after the aforementioned 12-month period no purchases are made using the MAX Card for a further consecutive period of 12 months, we shall, with immediate effect and without prior notice, withdraw your MAX Card.

12.3

DAF is entitled to withdraw your MAX Card if the DAF Service DealerTM you specified is no longer part of the authorised DAF dealer network, unless you indicate a different DAF Service DealerTM at www.paccarparts.co.uk/maxcard within 10 days of having been notified of this fact by DAF.

12.4

In the event of deception, the provision of incomplete or incorrect information, acting contrary to these conditions, the misuse of the rights you enjoy as a participant in the MAX Card programme, or if you act in any other way causing damage to us or the companies affiliated to us or the participating companies, we are entitled, subject to all our remaining rights, to terminate your registration with immediate effect and/or to deactivate your MAX Card.

  

13.

TERMINATION OF MAX CARD PROGRAMME OR TERMINATION OF PARTICIPATION OF A DAF SERVICE DEALER TM IN THE MAX CARD PROGRAMME

13.1

DAF Trucks N.V. retains the right to fully or partially terminate the MAX Card programme at any time observing a notice period of seven (7) working days by notification at www.paccarparts.co.uk/maxcard and/or e-mail.

13.2

A list of DAF Service DealersTM participating in the MAX Card programme can be found at www.paccarparts.co.uk/maxcard. DAF Trucks N.V. is entitled to add or remove DAF Service DealersTM from that list without any further notification.

13.3

Upon termination of the MAX Card programme or when discontinuing a DAF Service Dealer'sTM participation in the MAX Card programme, DAF Trucks N.V. shall never be required to compensate for any damages.

  

14.

CORRESPONDENCE/CHANGE OF ADDRESS

14.1

Correspondence relating to the MAX Card programme shall be sent to the last registered address that you provided to us. You must notify DAF Trucks N.V. of any changes of address at www.paccarparts.co.uk/maxcard, stating your old and new addresses and your MAX Card number.

  

15.

COMPLAINTS

15.1

Despite all care and attention we pay to our service and the MAX Card programme, you may experience some dissatisfaction. You can forward your complaint to our Marketing Support department via a web form at www.paccarparts.co.uk/maxcard.

  

16.

OTHER PROVISIONS

16.1

DAF Trucks N.V. is entitled to change or adapt these General Terms and Conditions. You are considered to have accepted changes to the General Terms and Conditions if you have not informed DAF Trucks N.V. within 14 days of receiving notification of the new DAF Trucks N.V. Terms and Conditions that you do not agree to the change or adaptation implemented, simultaneously cancelling your participation in the MAX Card programme.

16.2

The current version of the General Terms and Conditions can be found at www.paccarparts.co.uk/maxcard. The old General Terms and Conditions shall expire upon any changes made to the General Terms and Conditions.

16.3

Disputes may only be submitted to the competent court in ’s-Hertogenbosch, the Netherlands.

16.4

The MAX Card programme and these General Terms and Conditions are governed by Dutch law.
